By submitting a photo message to the COOKING UP GOOD VIBES initiative (the “Materials”), you agree to hereby irrevocably grant to Iovate the license and right to use the Materials and your name, image, physical likeness, capture, quotes, personal characteristics, and other personal identification as it appears in the Materials, for use by Iovate in connection with Muscletech® products and related promotions, advertising and other activities in perpetuity throughout the world, in any and all forms, formats, languages, manner and media, now known or hereafter devised, including but not limited to on the Muscletech® website, Muscletech® social media pages and in press releases. Without in any way limiting the foregoing, you agree that Iovate shall have sole discretion in determining the extent and manner of use of the Materials, and Iovate is not obligated in any way to use the Materials in any medium.

You agree that you have no rights to review, edit, or limit any use of the Materials in any medium. Iovate shall be entitled to edit the Materials as it deems appropriate. You agree that you will have no right of approval, no claim to any compensation, and no claim (including without limitation, claims based upon invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, distortion, illusionary effect, faulty reproduction, fictionalization, or use in any composite form of the Materials.

You irrevocably waive any and all “moral rights” in connection with the Materials and all rights to seek injunctive or other equitable relief.
